Terms of Service

What ProspectIQ does, what it does not promise, and the rules for using it.

1. Who may use ProspectIQ

ProspectIQ is a recruiting support service for high school athletes. You must be at least 13 years old to hold an account. If the athlete is under 18, a parent or legal guardian must create the account, accept these terms, and consent to the athlete's participation. The adult who accepts is responsible for the account.

We do not knowingly create accounts for children under 13. If we learn that an account belongs to a child under 13, we will close it and delete the associated information.

2. What the service does

ProspectIQ maintains a record of college programs and coaches, drafts introductory outreach on the athlete's behalf, and tracks what happens next — replies, film views, camp invitations. Drafts are generated with the help of automated tools and are reviewed by a person before any message is sent.

Messages are sent under the athlete's name. By using the service you authorize us to prepare and, once you approve the arrangement, send such messages on the athlete's behalf.

3. What the service does not promise

We do not guarantee any outcome. ProspectIQ does not promise that any coach will reply, that the athlete will be recruited, offered a roster spot, offered admission, or offered any athletic or academic scholarship or other financial aid.

ProspectIQ is not a sports agency and does not act as an athlete agent. We do not negotiate on the athlete's behalf, do not procure employment or endorsements, and do not take any share of any scholarship, stipend, or name-image-likeness compensation.

Nothing we provide is legal advice, admissions advice, financial aid advice, or an interpretation of NCAA, NAIA, NJCAA or state athletic association rules. Eligibility rules change and are the athlete's and family's responsibility. You should confirm compliance with the relevant governing body and the athlete's high school.

4. Information you give us must be accurate

Outreach speaks in the athlete's voice to real college staff. You are responsible for the accuracy of what you provide — grades, test scores, positions, video, and biographical details.

We will not state academic figures as verified fact in outreach unless a transcript has been uploaded and checked by our staff. Do not ask us to send a claim you cannot support. Submitting a falsified transcript or knowingly false athletic or academic information is a material breach of these terms and we may close the account without refund.

5. Your account

Keep your password confidential and tell us promptly if you believe someone else has access. You are responsible for activity under your account. One account covers one athlete.

6. Acceptable use

You agree not to:

  • use the service to send unlawful, harassing, deceptive, or bulk unsolicited commercial messages;
  • impersonate another person, including another athlete, a parent, a coach, or a school official;
  • upload content you do not have the right to share, including film or photographs of other people who have not agreed;
  • attempt to access another family's data, probe or interfere with the service, or scrape our coach and program research;
  • resell, sublicense, or redistribute our research or the service.

7. Content you upload

You keep ownership of what you upload — film, photographs, transcripts, and written material. You grant us a limited licence to store it, process it, and include it or links to it in outreach and in the athlete's profile, solely to provide the service. That licence ends when the content is deleted, except for copies retained in backups for a limited period or as required by law.

We do not use your content to advertise ProspectIQ or to promote another athlete without asking you first.

8. Automated drafting

We use automated language tools to prepare drafts from the information you provide and our own program research. Automated systems can produce inaccurate text. A person reviews each message before it is sent, but review is not a guarantee against every error. You may review and edit any draft, and you may ask us to stop sending at any time.

9. Payment

Fees, billing period, and what is included are shown at the time of purchase. Fees are charged in advance. Unless the purchase page says otherwise, payments are non-refundable except where required by law, and cancelling stops future charges rather than refunding the current period.

Because we do not promise any recruiting outcome, fees are not contingent on and not refundable based on recruiting results.

10. Ending the relationship

You may stop using the service and ask us to close the account at any time by writing to [CONTACT EMAIL]. We may suspend or close an account that breaches these terms, that we are required to close by law, or where continuing would expose us or a third party to harm. On closure we stop outreach and handle your data as described in the Privacy Policy.

11. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that our program and coach research is complete or current.

12. Limitation of liability

To the fullest extent permitted by law, ProspectIQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost recruiting opportunities, lost scholarships, or lost profits, arising out of or relating to the service.

Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify and hold ProspectIQ harmless from claims arising out of information you provided that was inaccurate, content you uploaded that you did not have the right to share, or your use of the service in breach of these terms.

14. Changes to these terms

We may update these terms. When we do, we publish a new version with a new effective date and ask you to accept it before further outreach is approved for the athlete. Continuing to use the service after a change means the current version applies.

15. Governing law and disputes

These terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. The state and federal courts located in [STATE] have exclusive jurisdiction, and you and we consent to venue there.
